The Supremacy Clause makes it clear that when state law is in conflict with federal law, federal law preempts state law. There have been many lawsuits claiming that state laws conflict with federal laws and are therefore invalid. In our reading this week, your textbook gives several examples, like Gade and Cippoloni.  In Gonzales v. Oregon, 546 U.S. 243 (2006), the court considered whether Congress, in enacting the Controlled Substances Act, intended to preempt state laws such as that of Oregon’s Death with Dignity Act, which authorized physicians to prescribe lethal doses of controlled drugs for terminally ill patients.

Using and applying the principles that we have learned about in chapter six of our textbook, provide another example of where states have been sued for trying to preempt a federal law.
